California presumes a worker is an employee unless the club can show all three: A, the entertainer is free from the club's control and direction, on paper and in fact; B, the work is outside the club's usual course of business; C, the entertainer runs an independently established business of the same kind. Answer for how the club actually works, not how the contract reads.
Record how the club engages its entertainers, and when that was decided. A contractor arrangement can be recorded only on a signed audit no more than twelve months old in which all three prongs hold.
